Please read these Terms of Service carefully before using the Scan AI mobile application.

1. Acceptance of Terms

By downloading, installing, or using Scan AI ("the App," "the Service," "We," "Us," or "Our"), you ("User," "You," or "Your") accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Scan AI is a mobile application that provides:

• Product scanning via camera or photo upload (image recognition)
• Shrinkflation detection and scoring (0-100 scale)
• Historical product size and pricing information
• Future shrinkflation predictions
• Product watchlist and notification alerts
• Milestones and achievements tracking
• Scan history and analytics

3. User Accounts

3.1 Account Creation

You may create an account using Google Sign-In or Apple Sign-In. By creating an account, you agree to provide accurate, current, and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Deletion

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, though we may retain certain information as required by law or for legitimate business purposes.

4. Use License and Restrictions

4.1 Grant of License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

4.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written consent
• Remove, alter, or obscure any proprietary notices on the App

• Use the App to violate any applicable laws or regulations

5. Product Data and Disclaimers

5.1 Educational Purpose

Scan AI is an educational tool designed to inform consumers about potential shrinkflation trends. The information provided is NOT financial, legal, or professional advice.

5.2 Data Sources

Our data is aggregated from publicly available sources including:

• News reports and consumer publications
• Product databases and manufacturer disclosures
• Historical pricing and sizing information
• User-submitted scan data
• Third-party APIs and data providers

5.3 No Guarantees of Accuracy

WE DO NOT GUARANTEE that:

• All product information is accurate, complete, or current
• Shrinkflation scores reflect actual product changes
• Predictions will accurately forecast future product modifications
• Third-party data sources are error-free
• All products in a category are represented in our database

Product sizes, prices, and formulations may vary by region, retailer, and time period. You are solely responsible for verifying product information before making purchasing decisions.

5.4 No Independent Testing

Unless explicitly stated otherwise, Scan AI does not conduct independent laboratory testing or product verification. Our data reflects publicly reported information and user-generated scan data.

5.5 User Responsibility

By using Scan AI, you acknowledge that:

• You will independently verify product information
• You will not rely solely on our data for purchasing decisions
• You understand that market conditions and product offerings change frequently
• You will consult qualified professionals for financial or legal advice

6. User-Generated Content

6.1 Scan Data

When you scan products using the App, you may create user-generated content including photos and product identifications. By submitting this content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your scan data to improve the Service, enhance our database, and provide analytics.

6.2 Content Standards

You agree that your user-generated content will not:

• Contain false or misleading information
• Violate any third-party rights (privacy, copyright, trademark)
• Contain offensive, harmful, or inappropriate material
• Promote illegal activities

7. Camera and Photo Permissions

The App requires camera and photo library permissions to scan products. By granting these permissions, you consent to our use of your camera and photos solely for the purpose of product identification and analysis. We do not access your photo library except for images you explicitly select for scanning.

8. Push Notifications

With your consent, we may send push notifications for:

• Scan completion alerts
• Watchlist product updates
• Achievement unlocks and milestone celebrations
• Streak reminders

You may disable notifications at any time through your device settings or the App settings.

9. Analytics and Advertising

9.1 Data Collection

We use third-party analytics services to collect data about App usage, performance, and user behavior. This data helps us improve the Service and user experience.

We reserve the right to use aggregated and anonymized user data for advertising purposes, including:

10. Intellectual Property Rights

The App, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, is owned by Scan AI and is protected by United States and international copyright, trademark, patent, and other intellectual property laws.

10.2 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation or attribution.

11. Subscriptions and Payments

Scan AI offers a premium subscription for $29.99/year:

• Subscriptions are billed through your Apple App Store account
• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• Refunds are subject to the App Store refund policies
• We reserve the right to modify pricing with advance notice

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Scan AI, its affiliates, officers, directors, employees, agents, and licensors SHALL NOT BE LIABLE for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from reliance on product information, scores, or predictions
• Damages arising from purchasing decisions made based on App data
• Damages from unauthorized access, data breaches, or system failures
• Damages from third-party content or services

OUR TOTAL LIABILITY for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the past 12 months, or (b) $100 USD.

12.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free from viruses or harmful components
• Results obtained from the App will be accurate or reliable

13. Indemnification

You agree to indemnify, defend, and hold harmless Scan AI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content
• Your purchasing decisions made based on App data

14. Termination

14.1 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or government agencies
• Discontinuation of the Service

14.2 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Your account data may be deleted (subject to our Privacy Policy)
• Provisions that by their nature should survive (disclaimers, limitations of liability, indemnification) will remain in effect

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits or class-wide arbitration.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms within the App
• Updating the "Last Updated" date
• Sending an in-app notification or email (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scan AI regarding the Service and supersede all prior agreements and understandings.
